Customs value of Chinese textiles and clothing to include export tax
Customs have released Australian Customs Notice 9 of 2005 ("the ACN"). China imposed export taxes on certain textiles and clothing from 1 January 2005, for a period of three years. This ACN addresses Customs' view of the impact of export duties on valuation declared in the import entry.
In summary, the view of Customs is that if the amount paid or payable for the goods includes the Chinese export tax, then that tax should be included in the "customs value" on which customs duty is payable. The ACN indicates that where the export tax is borne by the Chinese exporter, then it should not be included in the customs value.
It is recommended that all importers of Chinese textiles and clothing:
- Determine whether the goods being imported are textiles and clothing on which the export tax is payable;
- Determine whether the export tax has been borne by the importer;
- Review their import entries relating to these goods to determine whether the export duties have been included, then review the correct customs value on the relevant goods and, as appropriate, make the relevant voluntary disclosure.
It is further recommended that in situations where export duties are paid or payable by the importer, the review of the customs value ought to be undertaken by a qualified professional and formal rulings should be sought from Customs.
