CBP Issues Final Rule on Quarterly HMF


U.S. Customs and Border Protection (CBP) has published in the November 24, 2009 edition of the Federal Register a final rule with regard to harbor maintenance fees (HMF).

The final rule amends part 19 of the Code of Federal Regulations (10 CFR) to establish an option for payers of quarterly HMF to submit payments or refund requests online. CBP will still accept payments or refund requests by mail.

The rule also clarifies that both payments and refund requests must be accompanied by CBP Forms 350 (HMF Amended Quarterly Summary Report) and 349 (HMF Quarterly Summary Report).

According to the rule, the changes are "intended to provide the trade with expanded electronic payment/refund options and to modernize and enhance CBP's port use fee collection efforts."

The final rule becomes effective December 24, 2009.
